These Terms & Conditions (“Terms”) govern your access to and use of YoPeak, a service provided by Shouryanga Technologies LLP (“Company”, “we”, “us”, or “our”). By accessing or using YoPeak, you agree to be bound by these Terms. If you do not agree, you must not use the service.
1. Service Description
YoPeak is a digital platform that provides health, fitness, and performance insights by integrating data from third-party wearable devices and related sources. YoPeak is intended for informational and personal use only. YoPeak is not a medical device and does not provide medical advice, diagnosis, or treatment.
2. Eligibility
You must be at least 18 years of age to use YoPeak. By using the service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account & Authentication
You may be required to create an account to access certain features. Authentication is handled via passwordless (magic link) login. You are responsible for maintaining the security of your account and must notify us immediately of any unauthorized use at abhinav@yopeak.com.
4. Subscription, Billing & Renewal
YoPeak may offer a free trial. After the trial period, continued access requires a paid subscription. Subscriptions auto-renew unless cancelled before the renewal date. Pricing is displayed at checkout and may be updated with reasonable notice.
5. Acceptable Use
You agree not to reverse engineer the platform, use automated tools such as bots or scrapers (other than AI assistants you have connected through YoPeak’s own connector), share account access, or use the service for any unlawful or harmful purpose. We reserve the right to suspend or terminate accounts that violate these terms.
6. Health Data & Disclaimer
YoPeak processes and displays data obtained from third-party wearable devices and APIs. We do not guarantee the accuracy, completeness, or reliability of this data. All insights are provided for informational purposes only and are not a substitute for professional medical advice. You should consult a qualified healthcare provider before making health-related decisions.
7. Data Ownership & Usage
You retain ownership of your personal and health data. By using YoPeak, you grant us a limited license to process your data solely for providing and improving the service. We do not sell your personal health data.
8. Intellectual Property
All rights, title, and interest in YoPeak, including its software, design, branding, and content, are owned by Shouryanga Technologies LLP. You are granted a limited, non-exclusive, non-transferable license to use the service for personal use.
9. Termination
We may suspend or terminate your access if you violate these Terms or if your use poses risk to the platform. You may terminate your account at any time.
10. Limitation of Liability
YoPeak is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Shouryanga Technologies LLP shall not be liable for any indirect, incidental, or consequential damages, including loss of data, profits, or decisions made based on insights from the service.
11. Indemnification
You agree to indemnify and hold harmless Shouryanga Technologies LLP from any claims, damages, or liabilities arising from your use of the service, your violation of these Terms, or misuse of the platform.
12. Modifications to Terms
We may update these Terms from time to time. Continued use of YoPeak constitutes acceptance of the updated Terms.
13. Third-Party Services
YoPeak integrates with third-party services and APIs. We are not responsible for their availability, accuracy, or any issues arising from their use. YoPeak is not affiliated with or endorsed by any wearable manufacturer or AI assistant provider mentioned in the service.
14. AI Assistant Connections
You may connect your YoPeak account to third-party AI assistants, such as Claude or ChatGPT. You do this by signing in to YoPeak and approving access, and you can disconnect at any time from within the assistant. A connected assistant can read your YoPeak data but cannot change your account or wearables. Your use of an assistant is governed by its provider’s terms and privacy policy, and we are not responsible for the assistant’s responses. Information an assistant gives you about your data is informational only and is not medical advice.
